The Tally Technology Group, Inc., SMS Terms and Conditions (“SMS Terms and Conditions”) is operated on behalf of the Tally Technology Group, Inc., (“Tally”, “we”, or “us”). These SMS Terms and Conditions govern your use of our text messaging programs, including one-time texts and subscription text services, where Tally texts you for alerts, promotions and other purposes (“SMS Texting Services”). Capitalized terms used in these SMS Terms and Conditions but not otherwise defined herein will have the meaning given to them in the Terms of Use.
1. Consent Not Required.
BY SIGNING UP FOR THE SMS TEXTING SERVICES, YOU AGREE TO RECEIVE MARKETING TEXT MESSAGES THROUGH THE SERVICES. HOWEVER, YOU ACKNOWLEDGE THAT YOU ARE NOT REQUIRED TO CONSENT TO RECEIVE MARKETING TEXTS THROUGH THE SERVICES AS A CONDITION OF USING THE TALLY SERVICES.
2. SMS Texting Services.
By signing up for SMS Texting Services, you agree that Tally may send you promotional text (including SMS and MMS) messages, including recurring text messages, to any phone number you provide to us. When you opt-in to the SMS Texting Services, we will send you an SMS message to confirm your signup. We may also send additional informative messages on occasion, such as reminders to you that you are subscribed along with a reminder on how to opt out. The number of text messages you will receive will vary depending upon how you use our Services.
3. How to Opt Out.
You can cancel the SMS Texting Services at any time. Just text "STOP" to +1 866-340-6056. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS or MMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS and/or MMS messages to you again.
4. Help.
If at any time you forget what keywords are supported, just text "HELP" to +1 866-340-6056. After you send the SMS message "HELP" to us, we will respond with instructions on how to use our SMS Texting Services as well as how to unsubscribe.
5. Autodialing.
Tally or our service providers may use an automatic telephone dialing system to deliver text messages to you through our SMS Texting Services. By opting in to our SMS Texting Services, you consent to Tally’s or our service providers’ use of an automatic dialing system to deliver text messages to the telephone number to which you have directed Tally to transmit these text messages.
6. Fees; Mobile Carrier Charges.
We do not charge for our SMS Texting Services; however, your mobile carrier’s standard data and messaging rates will apply. By providing your consent to participate in our SMS Texting Services, you approve any such charges from your mobile carrier. You represent that you are 13 years of age or older and the owner or authorized user of the mobile device associated with the telephone number you designate to receive messages from the SMS Texting Services. You also represent that you are authorized to approve the applicable carrier charges.
7. Mobile Carriers. We are able to deliver messages to the following mobile phone carriers:
Major carriers: AT&T, Verizon Wireless, Sprint, and T-Mobile USA.
Minor carriers: Aio Wireless, Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Boost Mobile, Carolina West Wireless, CellCom, Cellular One of East Central IL (ECIT), Cellular One of Northeast Arizona, Cellular One of Northeast Pennsylvania, Chariton Valley Cellular, Cricket, Coral Wireless (Mobi PCS), Cross, C-Spire (CellSouth), Duet IP (Maximum Communications New Core Wireless), Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Google Voice, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Metro PCS, Mosaic (Consolidated or CTC Telecom), MTA Communications, MTPCS (Cellular One Nation), Nex-Tech Wireless, Panhandle Communications, Peoples Wireless, Pine Cellular, Pioneer, RINA, Sagebrush Cellular (Nemont), SI Wireless/Mobile Nation, Simmetry (TMP Corporation), SouthernLinc, SRT Wireless, Thumb Cellular, Union Wireless, United Wireless, U.S. Cellular, Viaero Wireless, Virgin Mobile, and West Central (WCC or 5 Star Wireless).
Carriers are not liable for delayed or undelivered messages.
